Terms of Service

These Terms of Service ("Terms") govern your use of the website shrunk3djax.com and all services provided by Shrunk 3D Jacksonville LLC ("we," "us," or "our"), an independently owned and operated franchisee of Shrunk 3D Inc. By using our website or engaging our services, you agree to these Terms in full.

    Please read these Terms carefully before using our website or placing an order. If you do not agree, do not use our website or services.
  

1. Our Services

Shrunk 3D Jacksonville LLC provides mobile 3D scanning experiences and custom full-color 3D printed figurines. Our services include:

On-site 3D scanning at events, brand activations, and private bookings
Custom figurine production and direct-to-consumer shipping (3–4 week turnaround)
Event booking for weddings, corporate events, festivals, school events, and more
NIL and creator partnership programs
2D-to-3D figurine conversion services

All figurine production and shipping is fulfilled through the Shrunk 3D Inc. corporate network. By placing an order, you acknowledge that fulfillment is handled by Shrunk 3D Inc. on behalf of Shrunk 3D Jacksonville LLC.

2. Orders and Figurines

All figurine orders are custom-produced based on your 3D scan. By placing an order, you acknowledge and agree to the following:

All sales are final. Because every figurine is custom-made specifically for you, we do not accept returns or issue refunds once production has begun.
Turnaround time is approximately 3–4 weeks from the date your order is confirmed.
A $30 design fee per person or pet is included in the figurine price. Reprints of the same scan waive the design fee.
Shipping is $14.95 per address. We are not responsible for carrier delays once your order has shipped.
You are responsible for providing a complete and accurate shipping address. We are not liable for orders delivered to an incorrect address you provided.
Minor color variations may occur between the digital preview and the finished figurine due to the nature of full-color 3D printing. These variations are not considered defects.

Damaged or Defective Orders: If your figurine arrives damaged or with a verifiable production defect, contact us within 7 days of delivery at [email protected] with photos of the item and packaging. We will evaluate the claim and, at our discretion, issue a reprint or store credit. We are not able to process damage claims submitted after 7 days of the confirmed delivery date.

3. Event Bookings

By submitting an event booking inquiry or confirming a booking with Shrunk 3D Jacksonville LLC, you agree to the following:

A deposit may be required to hold your event date. Deposit amount and terms will be communicated at time of booking confirmation.
Cancellations made less than 72 hours prior to the scheduled event may forfeit the deposit in full.
We reserve the right to cancel or reschedule due to equipment failure, severe weather, or other circumstances beyond our reasonable control. In such cases, a full refund of any deposit paid will be issued.
Packages are based on the stated duration. Additional hours beyond the booked package are available at $175 per hour, subject to availability.
The client is responsible for providing adequate indoor or outdoor space, accessible power, and a safe environment suitable for booth setup and operation.
360 videos are delivered to each guest approximately within 24 hours following the event via automated delivery to the phone number provided at the booth.

4. NIL and Creator Partnerships

Participation in the Shrunk 3D Jacksonville NIL/Creator Partner program is subject to review and approval. By submitting an application, you agree that:

Submission of an application does not guarantee acceptance into the program.
We reserve the right to decline any application at our sole discretion, with no obligation to provide a reason.
Approved partners grant Shrunk 3D Jacksonville LLC a limited, non-exclusive license to use their likeness solely for producing and listing their figurine on the Shrunk 3D platform.
Partners retain 100% of their self-set premium above retail price.
Premium payouts are processed monthly for the prior calendar month's completed sales.
We handle all printing, packing, and shipping. Partners have no inventory obligation.

5. Payments

Payment for figurine orders and event bookings is handled separately from this website via invoice, point-of-sale, or payment link. By confirming an order or booking, you agree to pay the stated amount in full prior to or at the time of service, unless otherwise agreed in writing.

We do not collect or store payment card information on this website.

6. User Conduct

By using our website and services, you agree not to:

Submit false, misleading, or fraudulent information on any form
Use our website for any unlawful or unauthorized purpose
Attempt to interfere with or disrupt our website, servers, or systems
Infringe on the intellectual property rights of Shrunk 3D Jacksonville LLC, Shrunk 3D Inc., or any third party

7. Intellectual Property

All content on shrunk3djax.com — including images, text, logos, and design — is the property of Shrunk 3D Jacksonville LLC, Shrunk 3D Inc., or their respective licensors. You may not reproduce, distribute, or use any content without prior written permission.

You retain ownership of your own likeness. By placing a figurine order, you grant us a limited license to use your 3D scan data solely for the purpose of producing your ordered figurine(s).

8. Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our website will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Shrunk 3D Jacksonville LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our website or services, including but not limited to loss of profits, data, or goodwill. Our total aggregate liability to you for any claim shall not exceed the total amount you paid for the specific order or service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Shrunk 3D Jacksonville LLC, its members, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our services, your violation of these Terms, or your infringement of any third-party rights.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or our services shall be resolved exclusively in the state or federal courts located in Duval County, Florida. You consent to personal jurisdiction in those courts.

12. Changes to These Terms

We may update these Terms at any time. When we do, we will revise the "Last Updated" date at the top of this page. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
